Terms of Service (Public Offer Agreement)

1. General Provisions

1.1. These Terms of Service ("Agreement") constitute a public offer by Yevhenii Tretiak, sole proprietor registered in Ukraine (together, the "Provider"), to any legally capable individual (the "Customer"). By purchasing a course through https://en.photodestruction.com (the "Website"), the Customer accepts and agrees to this Agreement.

1.2. If you do not agree to these Terms, do not purchase or use our services.

2. Definitions

Website – https://en.photodestruction.com and related pages.
Course – a set of digital educational materials (pre-recorded video lessons, downloadable resources, guides, and supporting documents) made available online.
Course Package – the scope of access (number of lessons/materials and access duration) purchased by the Customer.
Account / Dashboard – the Customer's personal area created after purchase to access the materials.
Customer – an individual who purchases and uses the Course.
Provider – the sole owner and operator of the Website and Courses.
Paddle – Paddle.com Market Limited, Merchant of Record and payment processor for all transactions.

3. Subject of Agreement

3.1. The Provider grants the Customer a limited, personal, non-exclusive, non-transferable license to access the purchased Course Package after full payment.

3.2. Included: (a) access to pre-recorded video lessons; (b) downloadable supplementary materials (PDF guides, checklists, presentations); (c) digital confirmation of completion.

3.3. Not included: live workshops, real-time sessions, one-to-one consulting, curated communities, or private groups. All Course materials are pre-recorded digital content.

3.4. Recorded video review (where applicable). Certain Course Packages may include a recorded video review of homework submitted by the Customer. Such reviews are pre-recorded digital files prepared by the Provider's curator and delivered through the Dashboard. They do not constitute live consulting, real-time feedback, or one-to-one services.

3.5. Models Database access (where applicable). Certain Course Packages include access to the Models Database hosted at models.photodestruction.com. This access is personal, non-transferable, and provided for the duration of the Course Package. The Models Database is for informational and creative reference purposes only. The Provider does not facilitate direct contact, bookings, or arrangements between Customers and models listed in the database.

4. Payments

4.1. All payments are processed by Paddle.com Market Limited ("Paddle"), our Merchant of Record. Paddle handles billing, taxation, compliance and receipts.

4.2. Mandatory MoR statement. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

4.3. Prices are shown at checkout. Applicable taxes (e.g., VAT/sales tax) are calculated and collected by Paddle.

4.4. Payments are completed through Paddle's secure checkout. The Provider does not receive or store full payment card details.

4.5. Before completing a purchase, the Customer confirms they have read and accepted these Terms and the Refund Policy.

5. Access to the Course

5.1. After successful payment, the Customer receives an email confirmation and access to the Dashboard.

5.2. Access is provided for the duration stated at purchase (e.g., 3 months, 6 months, or as specified for the Course Package).

5.3. Access credentials must not be shared or transferred. Any such activity may lead to termination without refund.

5.4. Video Review Delivery (where applicable). Where the purchased Course Package includes a recorded video review of submitted homework, the Provider shall deliver the review within 7 business days of receiving the Customer's completed assignment submission via the Dashboard. Delays beyond this period due to technical issues will be communicated to the Customer.

6. Refund Policy

6.1. Refund eligibility and the specific conditions under which a refund may be requested are stated in the Provider's Refund Policy, which forms part of this Agreement, and are also visible on the product page of each Course at the time of purchase. By completing the purchase, the Customer confirms they have read and accepted the refund conditions applicable to that specific Course Package.

6.2. Different Courses may have different refund conditions (for example, refund availability tied to the amount of content accessed, or to a specific time window from the date of purchase). The conditions displayed on the product page at the time of purchase are binding.

6.3. To request a refund, contact info@photodestruction.com with your order details. Where eligible, refunds are processed by Paddle and may be reduced by applicable transaction fees, taxes, or bank charges.

6.4. Refund requests submitted outside the conditions stated on the product page will not be granted, except where required by applicable consumer protection law.

6.5. For billing questions, buyers may also contact Paddle Buyer Support via https://paddle.net.

6.6. Waiver of right of withdrawal (EU/UK consumers). By completing the purchase and gaining immediate access to the digital Course content, you expressly consent to the immediate commencement of performance and acknowledge that you waive your statutory right of withdrawal under Article 16(m) of EU Directive 2011/83/EU and equivalent UK regulations. The Provider's voluntary refund policy stated on the product page continues to apply.

7. Intellectual Property

7.1. All Course content (videos, texts, images, guides, documents) is protected by copyright.

7.2. The license is for personal, educational use only.

7.3. It is prohibited to copy, record, redistribute, resell, share access, or create derivative works for commercial use.

7.4. Violations may result in termination of access without refund and possible legal action.

7.5. Customer-uploaded content. The Customer retains all intellectual property rights in materials uploaded as part of assignments. By uploading materials, the Customer grants the Provider a limited, non-exclusive, royalty-free license to use the materials solely for the purpose of preparing and delivering the video review. The Provider will not use Customer-uploaded materials for marketing or any other purpose without separate written consent from the Customer.

7.6. Customer-uploaded content warranties. By uploading photographs or other materials as part of a Course assignment, the Customer warrants that: (a) they are the author or hold all necessary rights to share the materials; (b) they have obtained any required consent from individuals depicted, including parental or legal guardian consent for minors where applicable. The Customer agrees to indemnify the Provider against any claims arising from uploaded content that breaches these warranties.

8. Liability

8.1. The Course is provided "as is"; no specific results are guaranteed.

8.2. The Provider is not liable for (a) technical interruptions outside its control; (b) unmet expectations; (c) any indirect or consequential damages.

8.3. If liability is established, it is limited to the amount actually paid for the Course.

8.4. Mandatory protections. Nothing in this Agreement excludes or limits the Provider's liability for: (a) gross negligence or wilful misconduct; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under applicable consumer protection law.

9. Term and Termination

9.1. This Agreement enters into force at purchase and remains valid until access expiration.

9.2. The Provider may terminate access in case of violations (e.g., content sharing) without refund.

10. Governing Law and Dispute Resolution

10.1. This Agreement is governed by the laws of Ukraine.

10.2. Disputes shall first be resolved through negotiations; failing that, in the competent courts of Ukraine.
