Terms of Service (Public Offer Agreement)

1. General Provisions

1.1. These Terms of Service (“Agreement”) constitute a public offer by Yevhenii Tretiak, sole proprietor registered in Ukraine (together, the “Provider”), to any legally capable individual (the “Customer”). By purchasing a course through https://en.photodestruction.com (the “Website”), the Customer accepts and agrees to this Agreement.

1.2. If you do not agree to these Terms, do not purchase or use our services.

2. Definitions

Website – https://en.photodestruction.com and related pages.
Course – a set of digital educational materials (pre-recorded video lessons, downloadable resources, guides, and supporting documents) made available online.
Course Package – the scope of access (number of lessons/materials and access duration) purchased by the Customer.
Account / Dashboard – the Customer’s personal area created after purchase to access the materials.
Customer – an individual who purchases and uses the Course.
Provider – the sole owner and of the Website and Courses.
Paddle – Paddle.com Market Limited, Merchant of Record and payment processor for all transactions.

3. Subject of Agreement

3.1. The Provider grants the Customer a limited, personal, non-exclusive, non-transferable license to access the purchased Course Package after full payment.
3.2. Included: (a) access to pre-recorded video lessons; (b) downloadable supplementary materials (PDF guides, checklists, presentations); (c) digital confirmation of completion.
3.3. Not included: live workshops/sessions, one-to-one consulting, curated communities or private groups. The product is digital-only.

4. Payments

4.1. All payments are processed by Paddle.com Market Limited (“Paddle”), our Merchant of Record. Paddle handles billing, taxation, compliance and receipts.
4.2. Mandatory MoR statement. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
4.3. Prices are shown at checkout. Applicable taxes (e.g., VAT/sales tax) are calculated and collected by Paddle.
4.4. Payments are completed through Paddle’s secure checkout. The Provider does not receive or store full payment card details.
4.5. Before completing a purchase, the Customer confirms they have read and accepted these Terms and the Refund Policy.

5. Access to the Course

5.1. After successful payment, the Customer receives an email confirmation and access to the Dashboard.
5.2. Access is provided for the duration stated at purchase; if no duration is specified, a minimum of 6 months is guaranteed.
5.3. Access credentials must not be shared or transferred. Any such activity may lead to termination without refund.

6. Refund Policy

6.1. The Customer may request a refund within 14 days of purchase provided that a substantial portion of the Course has not been accessed or downloaded.
6.2. To request a refund, contact photodestruction@gmail.com with your order details. Where eligible, refunds are processed by Paddle and may be reduced by applicable transaction fees, taxes, or bank charges.
6.3. After 14 days, or once substantial content has been accessed, refunds are not provided.
6.4. For billing questions, buyers may also contact Paddle Buyer Support via https://paddle.net.

7. Intellectual Property

7.1. All Course content (videos, texts, images, guides, documents) is protected by copyright.
7.2. The license is for personal, educational use only.
7.3. It is prohibited to copy, record, redistribute, resell, share access, or create derivative works for commercial use.
7.4. Violations may result in termination of access without refund and possible legal action.

8. Liability

8.1. The Course is provided “as is”; no specific results are guaranteed.
8.2. The Provider is not liable for (a) technical interruptions outside its control; (b) unmet expectations; (c) any indirect or consequential damages.
8.3. If liability is established, it is limited to the amount actually paid for the Course.

9. Term and Termination

9.1. This Agreement enters into force at purchase and remains valid until access expiration.
9.2. The Provider may terminate access in case of violations (e.g., content sharing) without refund.

10. Governing Law and Dispute Resolution

10.1. This Agreement is governed by the laws of Ukraine.
10.2. Disputes shall first be resolved through negotiations; failing that, in the competent courts of Ukraine.
